The Hickman/Butcher Ranch on Bingham Creek, Utah

  The following may seem to be just a collection of dry legal documents, but they document the land holdings of Bill Hickman, his daughter Sarah Catherine, her husband Samuel Monroe Butcher and several of their children near the mouth of Bingham Canyon.  These are lands that were used for ranching and farming.  Lode and Placer mining claims, also a major part of their investment, will be dealt with elsewhere.  Since these records were found in more or less random searches in the books at the Salt Lake County Recorder's office, it is likely there are other similar documents at the same location as yet undiscovered, also here.


25 November 1873, Book *T*, Liens and Leases, p.507:

This Indenture, made the twenty-fifth day of November in the year of
our Lord one thousand eight hundred and seventy-three, Between
Samuel M. Butcher & Sarah C. Butcher of Salt-Lake County Utah Territory
parties of the first part and the Bingham Canyon & Camp Floyd Rail
Road Company organized under the laws of Utah Territory the party of the
second part, Witnesseth: that the said parties of the first part, for and
in consideration of the sum of one hundred Dollars, lawful money
of the United States of America to them in hand paid by the said
party of the second part the receipt whereof is hereby acknowledged, have
granted, bargained, sold, aleined, remised, released, conveyed and
remise, release, convey and confirm unto the said party of the second
part and to the successors and assigns forever, all of the following
described easements and right of way to wit: the right of way for the
railway of the second party its successors and assigns upon the route
of said Railway as now surveyed, used and occupied by said second
party as the roadway through the lands of the first parties situated
on the west side of the Jordan River near the mouth of Bingham Canyon
Salt Lake County Utah Ty, being Section (16) sixteen Township three (3)
South Range two (2) West being 640 acres, together with sufficient
land and space adjoining to said track for the convenient and
unobstructed use of said road not to exceed twelve & one half feet on
each side from the centre of the track and the first parties hereby--
relase and forever discharge the second party from all damages &
claims of damage arising from the construction of the road through
said premises said 640 acres being now set apart for school purposes
& in a school section & the parties of the first part hereby in case of
sale of the above or any of the property described herein & defend the
title of the second party to the above right of way.
Together with all and singular the tenements, hereditaments
and appurtenances thereunto belonging or in anywise appurt-
aining, and the rents, issues and profits thereof; and, also all
estate, right, title, interest, property, possession, claim and demand
whatsoever as well in law as in equity of the said parties of the
first part, of, in or to the said premises and every part and
parcel thereof with the appurtenances.
To Have and To Hold all and singular the said premis-
es, together with the appurtenances unto the siad party of
the second part, and to its successors and assigns forever.  And
the said parties of the first part and their heirs, the said prem-
ises, in the quiet and peacable possession of the said party of the
second part its successors and assigns against the said parties
of the first part and their heirs, and against all and every
person and persons whomsoever lawfully claiming or to
claim the same shall and will Warrant and by these
presents forever defend.

costs and interest thereon out of the personal property of S.W.
Butcher, S.C. Butcher and W.A. Hickman, the defendants in
said action and if sufficient personal property could not be
found then out of the real property belonging to the said
defendants S.W. Butcher, S.C. Butcher and W.A. Hickman, on
the 15th day of July 1875 or at any time thereafter, as by
the said writ reference being thereunto had more fully appears;
I have levied on, and this day sold at public auction
according to the statute in such cases made and provided,
to John Shafer, who was the highest bidder for the sum of
One Hundred & Eighty ($180.00) dollars lawful money of the United
States of America, which was the whole price paid by him for

All the right title interest and estate which S.W. Butcher, S.C.
Butcher, and W.A. Hickman defendants, may have held on
the 22nd day of July AD 1875 or may have since acquired in and

sixteen (16) and known as the Butcher ranch or Farm "and
lying between the Farms or Ranches of "Mumford and Cotton",
situate in Bingham Cañon, County of Salt Lake and Territory

ments, and appurtinances therunto belonging or in anywise
appertaining, And I do hereby further certify that the said
property was sold in one lot or parcel, and that the said
real estate is subject to redemption in lawful money of the

General Land Office of the United States a Certificate of the Register of
the Land Office at Salt Lake City, Utah Territory, whereby it appears
that, pursuant to the Act of Congress approved 20th May, 1862, "To Secure
Homesteads to Actual Settlers on the Public Domain", and the acts sup-
plemental thereto, the claim of Samuel M. Butcher has been established
and duly consummated, in conformity to law, for the south west quar-
ter of the south east quarter of section fifteen, and the north west quarter
of the north east quarter, and the north half of the north west quarter of
section twenty two in township three south of range two west of Salt Lake
Meridian in Utah Territory, containing one hundred and sixty acres,
according to the Official plat of the Survey of the said Land, returned
to the General Land Office by the Surveyor General:
  Now Know Ye, that there is, therefore, granted by the United States
unto the said Samuel M. Butcher the tract of land above described:
To Have and To Hold the said tract of land, with the appurtinances
thereof, unto the said Samuel M. Butcher and to his heirs and assigns
forever; subject to any valid and accrued water rights for mining
[p.40] agricultural, manufacturing, or other purposes, and rights to ditches and
reservoirs used in connection with such water rights, as may be recogniz-
ed and acknowledged by the local customs, laws and decisions of courts,
and also subject to the right of the proprietor of a vein or lode to extract
and remove his ore therefrom, should the same be found to penetrate or
intersect the premises hereby granted, as provided by law.
In Testimony Whereof, I, Chester A. Arthur, President
of the United States of America, have caused these letters to be made
patent, and the seal of the General Land Office to be hereunto affixed.

Between Samuel M. Butcher and Sarah C. Butcher, his wife,
of Bingham, Utah parties of the first part, and Charles W. Watson and
George E. Chandler of the same place, the parties of the second part,
Witnesseth, That the said parties of the first part, for and in con-
sideration of the sum of Fifty Five hundred (5500) Dollars, lawful
money of the United States of America, to them in hand paid by
the said parties of the second part, the receipt whereof is hereby ack-
nowledged, do by these presents grant, bargain, sell, convey, and
confirm unto the said parties of the second part, and to their
heirs and assigns forever, all the following described real estate, some
of which is owned by said Sarah C. Butcher and some owned by
said Samuel M. Butcher, and all situate, lying and being in Salt
Lake county, Utah, to wit:
The North Half (1/2) of the northwest quarter (1/4) and the north-
west quarter (1/4) of the north west quarter (1/4), and the north-east quarter
of the north-east quarter (1/4) of Section twenty-two (22) Township three
(3) South of Range two (2) West Salt Lake Meridian: also, the southwest
quarter (1/4) of the south-east quarter (1/4) and the north-half (1/2) of the
South-east quarter (1/4), and the South-east quarter of the south-east quarter
(1/4) and all of the South-west quarter (1/4) of section fifteen (15) Township three (3)
South of Range two (2) West Salt Lake Meridian containing in all four
hundred and eighty (480) acres of land.  Also all the right, title and
interest of the first parties and each of them of in and to the the (sic)
waters of Bingham Creek, and also all other waters, water rights and
privileges and appropriations, and any and all springs, tanks, ditches
flumes, ways and casements, in or on said or any of said lands
or used thereon or in connection therewith or in any way appendant
or appertenant thereto.
And said Sarah C. Butcher hereby relinquishes and
bars all her dower and dower rights, in all such of the foregoing des-
cribed premises as she has dower or dower rights in or to.
The parties of the second part assume and agree to
[p.515] pay a certain mortgage made June 24, 1887, by the parties of the first
part securing the payment of their note of even date for $600 payable
six months after date to John A. Williams, with interest at 1 1/4%
per month, a part of the above described premises being included
in said mortgage.
Together with all and singular the tenements,
heriditaments and appurtenances thereunto belonging, or in anywise
appertaining, and the rents issues and profits thereof.
To Have and To Hold, all and singular the above
mentioned and described premises, together with the appurten-
ances, unto the said parties of the second part, their heirs and assigns
against the said parties of the first part, and their heirs, and
against all and every person and persons whomsoever, lawfully
claiming or to claim the same, shall and will Warrant, and

of Bingham Canyon Utah, the party of the first part, and George E.
Chandler and Charles W. Watson of the same place, the parties of the second part.
[p.490] Witnesseth, that the said party of the first part, for and in consideration
of the sum of Ten (10) Dollars, lawful money of the United States
to him in hand paid by the said parties of the second part, the receipt
whereof is hereby acknowledged, does by these presents remise
and forever Quit Claim unto the said party of the second part,
to his heirs and assigns forever, all that certain lot piece or parcel of
land, situated in the County of Salt Lake, Territory of Utah,
and particularly described as follows, to-wit:
All of section sixteen (16) in Township three (3) South
two (2) West, Salt Lake Meridian, U.S. Survey.

party of the first part, and Charles W. Watson and George E. Chandler, of the same place,
the parties of the second part, Witnesseth that the said party of the first part, for
and in consideration of the sum of One Thousand Dollars, lawful money of the
United States of America to him in hand paid by the said parties of the second
part, the receipt whereof is hereby acknowledged, does grant, bargain, sell alien,
remise, release, convey, and confirm and ^[insertion] by these presents does grant, bargain, sell,
alien, remise, release, convey and confirm^ unto the said parties of the second part,
and to their heirs and assigns forever, all that certain piece or parcel of
land situate, lying and being in County of Salt Lake, Territory of Utah, described
and bounded as follows to wit:
All of the South half <1/2> of the North West quarter <1/4>, and all of the South

interest, homestead rights, property, possession, claim and demand whatsoever,
